Stampz application / platform for users

1. INTRODUCTION

1.1 “Stampz” refers to the mobile application that allows brands and online creators to increase their reach, engagement and customer loyalty by allowing users to save for exclusive offers and rewards on products and services.

1.2. The following terms and conditions (“Terms of Use”) govern your use of the Stampz app and constitute a binding legal agreement between Brands, Online Creators, User and Stampz.

2. DEFINITIONS

2.1. “User” or “Savers” means any person or entity that uses or has used the Stampz app to participate in the various savings programs.

2.2. “Brands” means the companies that promote their products or services through the Stampz app.

2.3. “Online Creators” are individuals or entities who create and share content through online platforms, such as social media, and who partner with brands to promote their products or services.

2.4. “Offers” are exclusive deals, discounts or rewards offered by Brands and Online Creators to Users through the Stampz app.

3. ACCEPTANCE OF TERMS AND CONDITIONS

3.1. By using the Stampz app and participating in the savings programs, you accept these Terms of Use. If you do not agree to these Terms, you may not use the Stampz app.

3.2. Use of the Stampz app requires that you meet the minimum age requirement applicable in your jurisdiction.

4. SERVICE

4.1. The Stampz app provides a platform where users can save for exclusive offers from Brands and Online Creators. The specific details and rules of each Offer and savings program are determined and communicated by the Brands and Online Creators.

4.2. Stampz is not responsible for the content, quality or delivery of the products or services offered by Brands and Online Creators.

5. USER ACCOUNT

5.1. To participate in the savings programs through the Stampz app, you must create an account. You must provide accurate and complete information and keep it up to date.

5.2. By creating an account, you agree to receive emails about Stampz savings programs you can participate in or upcoming savings programs. You may unsubscribe from these emails at any time using the unsubscribe link in the email.

5.3. You are responsible for all activities that occur under your account and for maintaining the security and confidentiality of your account information and password.

5.4. You agree to immediately notify Stampz of any unauthorized use of your account or any other breach of security.

6. RULES OF USE

6.1. You may use the Stampz app and savings programs only for purposes that are lawful and in accordance with these Terms of Use.

6.2. You may not use the Stampz app in a way that may cause harm to Stampz, other users, the savings programs or third parties.

7. PRIVACY

7.1. Your privacy is important to us. Our Privacy Policy, included separately, explains how we collect, use and protect your personal information.

8. INTELLECTUAL PROPERTY RIGHTS

8.1. All intellectual property rights in and to the Stampz app, including but not limited to trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Stampz app, remain our property.

8.2. By accepting these Terms of Use, you agree not to contest or violate these rights.

9. CHANGES TO THE TERMS AND CONDITIONS

9.1. Stampz reserves the right to change these Terms of Use. We will make reasonable efforts to notify you of significant changes. Continued use of the Stampz app and participation in the savings programs following such changes constitutes your acceptance of the new terms.

10. LIMITATION OF LIABILITY

10.1. In no event shall Stampz, its partners, licensors and service providers be liable for any direct, indirect, special, incidental, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses, arising out of the use of the Stampz app or participation in the savings programs.

11. RELEASE

11.1. You agree to indemnify and hold Stampz, its affiliates, licensors and service providers harmless from any and all claims, liabilities, damages, judgments, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms of Use or your use of the Stampz app and participation in the savings programs.

12. DISCLOSURES

12.1. These Terms of Use shall be governed by and construed in accordance with the laws of the Netherlands.

12.2. All disputes arising out of or in connection with these Terms of Use shall be submitted to the competent court in ‘s-Hertogenbosch, the Netherlands.
